- Mingvo is not a law practice, does not provide legal advice, does not represent you, does not calculate or monitor legal deadlines, and does not create a lawyer-client relationship.
- AI can be wrong or incomplete. All AI content is candidate content for you to check, not a legal conclusion.
- Your case content is not sent to a lawyer by default. Conflict checking and substantive handover each require a separate, express action.
- Mingvo is not an emergency service and no person monitors your input in real time. If anyone is in immediate danger, call 000.
- Nothing in these terms limits a right that cannot be excluded under the Australian Consumer Law.
When you accept these terms
You may browse general pages that do not require an account without creating a case brief.
You accept the version of these terms shown at the time when you select “Start creating a case brief”, or an equivalent control, next to a clear notice and link that asks for your affirmative confirmation in the following form:
By selecting “Accept and expressly consent — continue”, you accept the current Terms of Use and expressly consent to the necessary sensitive-information and AI processing stated on the same page. Please also read the Privacy Policy.
When that confirmation function is enabled, we separately record the versions, language, time and evidence for Terms acceptance and sensitive-information/AI consent. Merely viewing, expanding details, scrolling a page or opening these terms is not acceptance or consent. If you do not agree, do not confirm or continue the case-brief workflow.
Accepting these terms is not blanket consent to every use of personal information. The same button also contains separately stated and separately recorded express consent limited to the case-brief sensitive-information/AI processing described on that page. The Privacy Policy and point-of-collection notice explain the processing. Future optional functions and lawyer handover remain subject to separate consent where applicable.
Service provider and eligibility
These terms are an agreement between you and MINGVO PTY LTD (ACN 701 213 032, ABN 92 701 213 032; “Mingvo”, “we”, “us”) concerning the Mingvo website, WeChat Mini Program and case-preparation functions. MINGVO PTY LTD is an Australian company based in New South Wales. Our contact email is mingvo.info@gmail.com.
You must:
- be at least 18 years old;
- have capacity to understand and accept these terms;
- use the service for yourself, or have lawful authority to assist another adult, prepare a minor applicant's information as a parent or guardian, or represent a relevant employer or sponsoring organisation; and
- use Mingvo to prepare for consultation about Australian family law, visas and immigration, or related combined matters.
Children must not create an account or use the case-preparation workflow themselves. An adult user may provide information about children where reasonably necessary and lawful.
What Mingvo provides
Subject to current functionality and availability, Mingvo may provide:
- a guided Chinese-language interview and questionnaire;
- upload, malicious-file scanning, text extraction and organisation of PDFs, images and descriptions;
- timelines, evidence excerpts and structured candidate information;
- a case brief and PDF for you to review, edit and confirm;
- general public legal information and safety resources;
- one-lawyer matching, conflict-first checking and handover after you choose to proceed;
- account functions such as saving, version history, archiving, export and deletion;
- necessary transactional messages about login, delivery and status.
Functions and interfaces may differ by device, access channel, service area and availability. Whether you use desktop Web, mobile Web or the WeChat Mini Program, your account, access and case status are determined by the records Mingvo holds.
Not legal services, advice or representation
Mingvo is an information-organisation and service-connection tool. It is not a law practice or autonomous lawyer. Unless and until you separately enter an engagement with an independent lawyer:
- Mingvo does not give legal advice tailored to your matter;
- a questionnaire, public information, AI output, case brief or match is not legal advice;
- Mingvo does not represent you before a court, another party, a government body or a lawyer;
- Mingvo does not file, serve, sign or approve a legal document;
- Mingvo does not determine, calculate, remind you of or guarantee any litigation, appeal, property, migration, protection-order or other deadline;
- using Mingvo does not create a lawyer-client, fiduciary, retainer or fee relationship;
- information provided to Mingvo does not automatically attract legal professional privilege merely because it is submitted to the platform.
Visa and immigration functions only organise the circumstances, application history and materials you provide. They do not select or recommend a visa pathway, calculate migration points, determine eligibility, compliance with visa conditions, applicability of family violence provisions or visa outcomes, or lodge an application for you. Legal assessments and immigration assistance should be provided by an appropriately qualified professional.
General legal information may be inapplicable because of time, jurisdiction or the facts of your matter. Before making a legal decision, signing an agreement, allowing a possible deadline to pass, filing with a court or acting or refraining from acting, check with a suitably qualified lawyer.
Safety and emergencies
Mingvo is not an emergency, crisis, medical, police, child-protection or family-violence response service. No person reads every input in real time, and automated safety prompts cannot identify every risk.
If you or another person is in immediate danger, call 000 or use an emergency or professional service appropriate to the circumstances. Do not rely on Mingvo to contact police, family, a lawyer or another agency.
In the limited circumstances authorised or required by law, such as to lessen a serious threat to life, health or safety, we may process or disclose necessary information. This does not mean that we undertake continuous monitoring or assume a rescue duty.
AI assistance and limitations
Mingvo uses narrowly scoped AI to help understand materials, propose candidate facts and draft a case brief. We check whether output follows the required format, is supported by available material and is suitable to show you. AI may still:
- misread an image or text;
- confuse a person, date, amount or event;
- omit context or generate inaccurate content;
- perform differently across Chinese, English, scan quality and complex materials.
Accordingly:
- AI-organised content may be wrong and must be checked by you before use;
- AI does not make legal judgments for you or a lawyer, or decide conflicts, a retainer, fees, deadlines or case status;
- output that lacks a source, does not pass checks or presents excessive risk may not be used, may be marked uncertain, or may be replaced by a result organised under preset rules;
- a case brief is not a complete evidence list, affidavit, court document or lawyer's advice.
Mingvo currently uses OpenAI's artificial-intelligence services to help organise real matters. If processing fails, we do not automatically transfer content to another AI provider. The Privacy Policy explains what is sent, possible overseas processing, retention and limits on model training. Mingvo does not use your case content to train its own or a third party's foundation model.
Guest use, accounts and security
7.1 Guest workspace
Mingvo may let you begin as a guest. A guest workspace ordinarily expires 24 hours after creation. If you do not verify an account and claim it before expiry, its narrative, materials and derived content enter an automatic-deletion workflow and may not be recoverable.
Guest status ordinarily permits only one active matter. Login may be required for long-term history, version confirmation, archiving, later handover and other account functions.
7.2 Account responsibility
You must:
- use an email account you are authorised to access;
- protect your email, device, verification codes and sessions;
- not share an account or allow unauthorised use;
- promptly tell us about suspicious login, incorrect handover or a security incident;
- keep contact details accurate for necessary service messages.
Do not send a verification code, password or recovery credential to anyone claiming to be Mingvo support. We may require reasonable identity verification before actioning an access, export, handover or deletion request.
Your content and responsibilities
“Your content” means a narrative you enter, questionnaire answers, uploaded materials, edits, instructions and other content in which you have rights.
You retain your existing rights in your content. You grant Mingvo a non-exclusive, royalty-free and limited licence, only as necessary to provide and protect the service and to process information in locations disclosed by the Privacy Policy, to host, copy, transform, scan, extract, pseudonymise, generate a case brief, carry out a handover at your direction, and perform backup and deletion. The licence ends when content is deleted, subject to legal preservation, rolling recovery copies and processing lawfully completed before deletion.
You agree to:
- provide information that is accurate to the best of your knowledge and check system-generated candidate information;
- upload only material reasonably relevant to your matter that you lawfully hold or are authorised to use;
- remove unrelated third-party information, account credentials, complete identity numbers and highly sensitive but unnecessary information where possible;
- not use Mingvo to fabricate, alter, conceal or destroy evidence;
- not use Mingvo to harass, surveil, threaten or locate a partner, former partner, child or another person;
- comply with protection orders, court orders, confidentiality obligations, intellectual-property rights and applicable law.
Where your content concerns another person, you confirm that you have a reasonable and lawful basis to provide it in preparing your own matter. Mingvo does not determine whether every document is admissible in proceedings or subject to confidentiality, privilege or discovery restrictions. Ask a lawyer first if uncertain.
Mingvo content and generated results
Mingvo and its licensors retain rights in platform software, interfaces, branding, templates, public legal information and underlying methods. We grant you a limited, revocable and non-transferable licence to use the service and public content for personal case-preparation purposes.
To the extent permitted by law, you may use and edit a case brief and export generated from your content for your own matter. Your rights in original inputs are unaffected. Because a generative system may produce similar results for different users, we do not promise that generated wording is original, unique, copyrightable or suitable without professional checking.
You must not copy platform software, bypass technical controls, scrape content at scale, reverse engineer a non-public component, or use service output or interfaces to build a competing dataset or model without written permission, except to the extent an applicable law expressly permits and does not allow contractual exclusion.
Privacy and data control
The Privacy Policy explains how we collect, use, disclose, process overseas, retain and delete personal information. It is an important explanation of the service arrangement.
Archiving is not deletion. Permanent deletion requires your express confirmation in the deletion prompt and may be affected by a legal hold, security investigation or rolling-recovery-copy period. Deleting Mingvo's copy cannot recall an email, delete a copy you downloaded or remove a copy independently retained by a lawyer.
Lawyer matching, conflict checking and handover
A lawyer match is a service connection based on limited information, not a guarantee about the lawyer's expertise, suitability, availability or outcome.
Unless the interface clearly explains it and you confirm:
- Mingvo does not automatically send your case to a lawyer;
- Mingvo does not broadcast one handover to multiple law practices;
- before conflict clearance, only necessary names and a limited reference go to the one lawyer or practice you select;
- only after conflict clearance are the frozen case brief and the contact details you confirm at the time made available.
You may separately select original material files already included in the confirmed version for the lawyer to view or download only after conflict clearance. Leaving this unchecked does not prevent sending the brief, and later additions are not shared automatically.
A status such as “willing to contact” or “contacted” does not mean the lawyer has accepted a retainer, verified the brief or formed a lawyer-client relationship. A retainer arises only when you and the lawyer/practice complete its express engagement process.
Under the current Mingvo workflow, preliminary review of the case brief and an initial case assessment are offered without charge as described in the interface. Substantive legal advice, consultation, representation, document work and ongoing services are separate services between you and the independent lawyer. Before you accept, the lawyer must disclose the applicable scope, fees and terms.
Lawyers and law practices are independent service providers responsible for their professional services, advice, conflict decisions, response time, fees and record retention. Mingvo does not share in legal fees and will not rank a match by payment priority without clear disclosure.
Fees and Australian consumer rights
Mingvo will not charge you unless, before a paid action, the product clearly displays the price, currency, billing period, cancellation and refund conditions and obtains your express agreement. A free or trial function is not guaranteed to remain free indefinitely.
A future paid function may have additional order terms. Additional terms cannot silently reduce rights in a fixed service you have already purchased.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies a right, remedy, guarantee or liability that applicable law does not allow us to exclude, restrict or modify.
Prohibited use
You must not use Mingvo to:
- engage in unlawful, fraudulent, threatening, harassing, stalking, coercive or harmful conduct;
- breach a court order, protection order, confidentiality obligation, privacy right or intellectual-property right;
- impersonate another person, access another person's matter without authority or mislead a lawyer;
- upload malware or destructive code, or deliberately evade scanning or a security control;
- probe, attack, overload or disrupt the platform, or evade an access or security limit;
- conduct high-volume automated scraping, resell an account, provide an unauthorised bureau service or build a competing model or dataset;
- generate or submit false evidence or a fabricated statement, or present unchecked AI content as verified fact or a lawyer's advice.
Good-faith security research requires prior written scope and rules from mingvo.info@gmail.com.
Availability and changes
We use reasonable care in maintaining the service but do not promise uninterrupted, error-free, always recoverable operation or suitability for every material and device. A file may be unprocessable because it is encrypted, corrupt, malicious, unsupported or poor quality. Where possible, we isolate a failed file and allow other readable content to continue.
We may repair, update, add or remove functions to improve security, compliance and service quality. We will not rely on a general variation clause to arbitrarily reduce a core entitlement during a fixed service you have already purchased. We give reasonable advance notice of a materially adverse change and, where appropriate, an option to stop, export or take another suitable step.
Suspension and termination
You may stop using Mingvo at any time and request export or deletion in accordance with the Privacy Policy and available product functions.
We may restrict, suspend or terminate access to protect users, comply with law, handle a security incident, maintain the system, or where we reasonably believe there has been a serious or repeated breach of these terms. Unless notice would create a legal or security risk, we explain the general reason and, where reasonably practicable, offer an appeal, export or deletion route.
Termination does not automatically delete every record. Retention and deletion are governed by the Privacy Policy. Terms dealing with intellectual property, responsibility, disputes, completed handovers and lawfully retained information continue to the extent necessary.
Third-party services
Mingvo relies on AWS, a transactional-email service and other reviewed technology suppliers, and may link to a court, government, support organisation, lawyer or law-practice website. The Privacy Policy identifies the main suppliers that process information on our behalf.
Independent third-party sites, court systems, government services, lawyers and law practices are not controlled by Mingvo. They are responsible for their content, availability, professional services and privacy practices. A link or match is not a guarantee or endorsement of everything they provide.
Disclaimers
Without affecting any non-excludable consumer guarantee:
- Mingvo provides an information-organisation tool and does not promise that a case brief is complete, correct, court-ready or capable of achieving a particular outcome;
- public legal information is general information and not a substitute for advice about your matter;
- AI and text recognition can be wrong, and you must check content before relying on or handing it over;
- Mingvo does not guarantee that a lawyer is conflict-free, will accept a retainer, will respond within a particular time or will achieve an outcome;
- an estimated completion time, match or status is workflow information, not a legal promise.
These statements do not relieve us of duties to provide services with due care and skill, meet a disclosed purpose where a consumer guarantee applies, or comply with another non-excludable obligation.
Liability
These terms do not exclude liability for our fraud, wilful misconduct, negligence that the law does not permit us to exclude, or breach of a non-excludable consumer guarantee.
To the extent permitted by law, each party is responsible for loss that is a reasonably foreseeable and direct result of that party's conduct. We are ordinarily not responsible for loss caused by:
- treating Mingvo as a lawyer, deadline service, court system or emergency service contrary to the clear service boundaries;
- failing to check AI or text-recognition content clearly marked as candidate or uncertain;
- your device or email account, unauthorised sharing, unlawful uploads or the independent conduct of a third party;
- an event that was not reasonably foreseeable when the agreement was made, is too remote or was not caused by our breach.
Every limitation must be read subject to the Australian Consumer Law and other applicable law. If the law permits liability for a guarantee concerning a service not ordinarily acquired for personal, domestic or household use to be limited, we may choose to provide the service again or pay the reasonable cost of re-supply. That limitation does not apply where the law does not permit it.
Complaints and disputes
For a service, fee or privacy issue, contact mingvo.info@gmail.com. Explain the problem and the outcome you seek. We investigate in good faith and respond within a reasonable period.
The parties should first try to resolve a dispute by direct communication. This does not prevent either party from seeking urgent injunctive relief, complaining to a regulator or exercising a non-excludable statutory right. Depending on the issue, you may also contact NSW Fair Trading, the ACCC, the OAIC or another competent body.
Governing law
These terms are governed by the applicable laws of New South Wales and the Commonwealth of Australia. The parties submit to the non-exclusive jurisdiction of courts with jurisdiction in New South Wales.
If, as a consumer, you are entitled to bring proceedings in another Australian State, Territory or jurisdiction, these terms do not remove that right.
Changes to these terms
We may update these terms for legal, security, supplier or functional changes and identify the new version and effective date. Merely viewing an update notice does not make a material new term retrospectively binding.
If a change materially affects an existing user's rights or obligations, we give reasonable advance notice and ask for fresh acceptance before the user next creates or continues a case brief or uses the affected function. An urgent security or legal change may take effect immediately, but we explain it promptly where reasonably practicable.
General
- Entire agreement: these terms, an expressly incorporated order and terms specific to a function form the agreement about the service. The Privacy Policy explains data processing; accepting it is not a waiver of statutory privacy rights.
- Severability: if a provision is invalid or unenforceable, it is adjusted or severed only to the minimum extent permitted by law, and the remainder continues.
- No waiver: a failure to enforce a right once is not a permanent waiver.
- Assignment: you may not transfer an account or this agreement without our written consent. We may transfer it only as part of a restructure or business transfer subject to the same protections under these terms and the Privacy Policy. We give notice and a choice where the transfer materially disadvantages you and law requires it.
- No third-party beneficiary: except where law provides otherwise or a specific term expressly states it, these terms create no enforceable right for a third party.
- Electronic communications: you agree to receive necessary service notices through the product and the email address you provide. Marketing, if introduced, will have a separate unsubscribe option.
Language
We provide Chinese and Australian English versions. They are intended to express the same agreement and help users genuinely understand it. The Chinese version has practical notice and contractual significance; it is not an ineffective reference translation.
If there is an irreconcilable inconsistency, the Australian English version prevails only to the extent permitted by law and cannot be used to reduce a right under the Australian Consumer Law, privacy law or another non-excludable law. Any ambiguity is interpreted in light of the notice actually presented, the user's reasonable understanding and applicable law.
